Does guarantor status continue following a house sale?
|
Q My husband is divorced. When he left his previous house he signed to be the guarantor of his ex-wife's mortgage, as she only works part time.
Before they divorced they re-mortgaged to get some improvements done, and as a result of this he also pays her an extra sum of money per month to cover the re-mortgage amount.
She is now selling the property and is combining the sale of her house with the sale of her mother's home and moving to Cornwall.
Will my husband still have to pay this extra amount per month and will he still be the guarantor for the mortgage?
I would be so grateful for a reply as this burden of being the guarantor hangs over us. We have bought our own small house together and realistically could not afford to pay her mortgage if she were unable to, as well as the extra amount my husband pays for the re-mortgage.
CP
A I can't comment on whether your husband will have to carry on paying the extra amount to his ex-wife to cover the re-mortgage, because it depends on their agreement.
But if it was made clear that the additional sum was only for the re-mortgage while it still had to be paid, it would seem reasonable to assume that once your husband's ex-wife sells her property and so repays the mortgage, your husband would no longer need to pay the extra amount.
As far as being a guarantor goes, once the mortgage has been paid off, the lender no longer needs this extra level of security, so your husband should no longer be held jointly responsible for his ex-wife's mortgage. And he certainly cannot be called upon to pay if she takes out a new mortgage for the house in Cornwall.
