Mortgage code compliance board

The role of the mortgage board is to ensure that customers are fully informed and adequately protected when taking out a mortgage.

All lenders and intermediaries registered with the board must adhere to the standards set out in the mortgage code.

A comprehensive programme of compliance inspection and compliance liaison visits is conducted each year. Additionally, "mystery shopping" and other consumer research exercises are conducted to ensure that consumers are receiving the full benefits of the code's protection.

The board conducts detailed investigations. When severe code breaches are proven it has the power, through an independent disciplinary process, to direct firms' future conduct and can fine, suspend, or de-register companies.

The FSA takes over the regulation of mortgages in October 2004. Currently complaints against firms that are not covered by the financial ombudsman services are covered by the Mortgage Code Arbitration Scheme (MCAS) but they will close their operations in 2004.
